Welcome to Djamila Celina.

These General Terms and Conditions apply to the use of our webshop and to all purchases made through our webshop. Please read these terms carefully before using our website or placing an order.

1. General

In these General Terms and Conditions, Djamila Celina is referred to as "we", "us" or "our".

The terms "you", "your" or "customer" refer to the visitor or customer of our webshop.

Our webshop is technically powered by Shopify. However, the sales contract for products ordered through our webshop is entered into directly between you and Djamila Celina.

By visiting, using or placing an order through our website, you agree to these General Terms and Conditions, to the extent permitted by law.

Our Privacy Policy and Return and Refund Policy form part of our webshop terms and apply to the use of our services.

2. Use of Our Webshop

You may only use our webshop for lawful purposes.

When creating an account or providing information during the ordering process, you must ensure that the information provided is accurate, current and complete.

You are responsible for keeping any account details confidential and for all activities carried out through your account.

You may not sell, transfer or make your account available to another person.

We reserve the right to restrict or terminate accounts or access to our webshop where we reasonably suspect that these General Terms and Conditions or applicable laws have been violated.

3. Our Products

We do our best to display our products, images, colours, sizes and product information as accurately as possible.

However, the actual colour or appearance of a product may vary depending on your screen, device, settings and other technical circumstances.

Images on our webshop are intended for illustrative purposes. Minor differences between product photographs and the actual product delivered do not automatically constitute a defect, provided that the product otherwise conforms to the agreement.

Product descriptions, prices, availability and other information may be changed when necessary.

We reserve the right to temporarily or permanently remove products from our range and to limit the available quantity of certain products, to the extent permitted by law.

4. Orders and Formation of the Contract

When you place an order through our webshop, you make an offer to purchase the selected products.

After placing your order, you will receive an automatic confirmation of receipt. This confirmation does not necessarily mean that we have already accepted your offer.

The sales contract is concluded when we expressly accept your order or when we ship the ordered products to you, depending on the applicable legal requirements.

We reserve the right to refuse an order where there is a legitimate reason, for example when:

  • a product is unavailable;

  • there is an obvious pricing or product error;

  • we reasonably suspect that an order is fraudulent;

  • there are problems with payment processing; or

  • an order cannot be delivered to the address provided.

If we cancel an order after your payment has already been processed, we will refund the relevant amount.

You are responsible for checking your order before placing it definitively.

5. Prices and Payments

All prices are displayed in the currency indicated during the checkout process.

For consumers within the European Union, prices are displayed including applicable VAT, unless otherwise stated.

Any shipping costs will be clearly displayed during the checkout process before you place your order.

Customs duties, import charges or other cross-border costs may apply where legally relevant. Where possible, information about such costs will be provided during the checkout process.

Prices, discounts and promotions may be changed. The price applicable to your order is the price displayed during checkout and stated in your order confirmation.

Where there is an obvious error in a price or product information, we reserve the right to correct the error. If your order is affected by such an error, we will inform you as soon as possible and, where necessary, cancel the order and refund any amounts already paid.

You confirm that you are authorised to use the payment method selected by you.

6. Delivery

We deliver to destinations within Europe where delivery is available.

The estimated delivery time is stated during the checkout process or at another designated location on our website.

Delivery times are estimates unless expressly agreed otherwise or otherwise required by law.

If a delay occurs due to circumstances beyond our reasonable control, we will inform you where possible.

However, we remain responsible for our legal obligations regarding delivery, and the risk of loss or damage to the goods will not pass to you earlier than permitted under applicable consumer law.

If an order is not delivered within the agreed or legally applicable period, statutory consumer rights may apply.

7. Ownership and Risk

For consumers, the risk of loss or damage to the products generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, actually receives the products.

This provision does not affect mandatory consumer protection laws.

8. Right of Withdrawal for Consumers

When you place an online order with us as a consumer, you generally have the statutory right to withdraw from the agreement within 14 days without giving any reason.

The statutory withdrawal period for goods generally begins on the day on which you, or a third party designated by you other than the carrier, receive the goods.

If an order consists of multiple goods delivered separately, the withdrawal period may begin when the last item is received.

To exercise your right of withdrawal, you must clearly inform us of your decision to withdraw before the expiry of the withdrawal period.

You may also use the statutory model withdrawal form, although this is not mandatory.

Consequences of Withdrawal

If you validly withdraw from the agreement, we will refund all payments received from you, including the standard delivery costs paid for the original order.

We may withhold the refund until we have received the returned goods or until you have provided evidence that you have sent the goods back, whichever occurs first.

The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.

You must return the goods without undue delay and no later than 14 days after informing us of your withdrawal.

You are generally responsible for the direct costs of returning the goods, unless we have expressly indicated that we will bear these costs or applicable law provides otherwise.

You are only liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The statutory right of withdrawal may be excluded in certain cases, for example for certain personalised products or other products for which an exception applies by law.

9. Statutory Warranty and Defective Products

We are responsible for the statutory conformity of the products we sell to consumers.

If a product does not conform to the agreement, you retain the rights granted to you under applicable consumer law.

Depending on the circumstances, this may include the right to:

  • free repair;

  • replacement;

  • a price reduction;

  • termination of the agreement; or

  • other statutory remedies.

Your statutory consumer rights are not limited or excluded by these General Terms and Conditions.

Within the European Union, consumers generally benefit from a statutory minimum guarantee of two years for new goods, with the precise application depending on the applicable national law.

10. Returns

Returns made under the statutory right of withdrawal or due to a defect will be handled in accordance with applicable law and our Return and Refund Policy.

11. Intellectual Property

All content on our webshop, including but not limited to:

  • brand names;

  • logos;

  • texts;

  • photographs;

  • images;

  • illustrations;

  • videos;

  • audio;

  • designs;

  • product presentations;

  • graphic elements;

  • product descriptions; and

  • the selection and arrangement of these elements,

is owned by Djamila Celina, its licensors or other rights holders and is protected by applicable intellectual property laws.

You may only use our content for personal and non-commercial purposes unless you have obtained our prior written permission or applicable law provides otherwise.

You may not, without prior permission, copy, reproduce, distribute, publish, modify, sell, reuse or otherwise commercially exploit content from our webshop.

The name Djamila Celina, our logos, product names, designs, slogans and other brand elements may not be used without our prior written permission.

All rights not expressly granted to you remain with Djamila Celina or the relevant rights holder.

12. Third-Party Services and Links

Our webshop may use services, features and tools provided by third parties.

Our websites may also contain links to third-party websites.

We are not responsible for the content, availability, accuracy or privacy policies of third-party websites.

When you visit an external website, you do so at your own risk.

The terms and privacy practices of the relevant third-party service provider may apply separately.

13. Shopify

Our webshop is hosted and technically supported by Shopify.

Shopify provides the technical infrastructure through which we offer our webshop to you.

However, the sales contract for products purchased through our webshop is entered into directly with Djamila Celina.

Shopify is not a party to the sales contract between you and Djamila Celina and, to the extent permitted by law, is not responsible for the performance of the sales agreement between you and us.

To the extent permitted by law, Shopify's liability in relation to your purchase from Djamila Celina is excluded.

14. Reviews and Feedback

When you voluntarily share a review, rating, photograph, suggestion, feedback or other material with us, you grant us permission to use this material for operating, improving and promoting our webshop and products, to the extent permitted by law.

You confirm that you are authorised to share the material submitted by you and that it does not infringe any third-party rights.

You may not submit material that is unlawful, threatening, discriminatory, abusive, defamatory, pornographic, fraudulent or otherwise inappropriate.

We may remove content when we reasonably believe that it violates the law, these terms or the rights of third parties.

We are not required to publish, retain or respond to submitted feedback or reviews.

15. Prohibited Use

You may only use our webshop for lawful purposes.

You are not permitted to:

  • violate applicable laws or regulations;

  • infringe our intellectual property rights or those of third parties;

  • provide fraudulent or misleading information;

  • harass, threaten or insult our employees or other persons;

  • distribute malware, viruses or other harmful code;

  • use our webshop for spam, phishing or other fraudulent activities;

  • impersonate another person or organisation;

  • collect personal data of other users without permission;

  • copy, scrape or exploit our webshop or parts thereof without permission;

  • circumvent security measures; or

  • use our systems in a way that could disrupt the operation of the webshop.

We may take appropriate measures when we determine that our webshop is being used in a prohibited manner.

This provision does not limit any rights you have as a consumer under mandatory law.

16. Automated Access and AI Agents

Automated systems, bots, crawlers, spiders, scraping tools or other software may not be used to systematically access our webshop, collect data or perform automated transactions unless prior permission has been granted or such access is legally permitted.

Where we impose technical identification requirements on automated systems, such systems must identify themselves in accordance with those requirements.

Automated systems may not circumvent security measures, CAPTCHAs, access restrictions, robots.txt instructions or other technical access controls.

This provision does not restrict the right of search engines or other systems to access our website where such access is legally permitted and has not been excluded by technical measures.

17. Availability of the Webshop

We strive to keep our webshop as reliable and available as possible.

We may temporarily suspend the webshop due to, for example, maintenance, technical problems, security updates or circumstances beyond our reasonable control.

We do not guarantee that our webshop will always be available without interruptions, errors or delays.

This does not limit any statutory consumer rights.

18. Errors and Inaccuracies

Despite our efforts, our webshop may occasionally contain typographical errors, pricing errors, incorrect product information or other inaccuracies.

When such an error is discovered, we reserve the right to correct the relevant information.

If an error relates to an order that has already been placed and the error is material, we will inform you as soon as possible and, where necessary, cancel the order and refund any amounts already paid.

Statutory consumer rights remain fully applicable.

19. Liability

We are liable in accordance with applicable statutory provisions.

Nothing in these General Terms and Conditions excludes or limits our liability where such exclusion or limitation is not permitted by law.

This applies in particular to liability arising from:

  • intent or gross negligence;

  • death, personal injury or damage to health;

  • statutory product liability;

  • an expressly provided guarantee, where applicable; or

  • other cases where liability may not legally be excluded or limited.

To the extent permitted by law, we are not liable for indirect damage, consequential damage, loss of profits, loss of revenue or loss of data that does not directly result from a breach of a statutory or contractual obligation by us.

This limitation applies only to the extent permitted by law and does not affect mandatory consumer rights.

20. Force Majeure

We are not liable for delays or non-performance caused by circumstances beyond our reasonable control, to the extent permitted by applicable law.

Such circumstances may include, for example:

  • natural disasters;

  • war;

  • government measures;

  • strikes;

  • serious disruptions to transportation;

  • failures at external service providers;

  • cyber incidents;

  • serious technical failures; or

  • other circumstances that could not reasonably have been foreseen or prevented.

When such a situation occurs, we will make reasonable efforts to limit its consequences.

21. Termination

We may restrict or terminate your access to certain functions of our webshop where this is necessary due to misuse, fraud, violation of these terms or legal obligations.

Such termination does not affect rights and obligations that arose before termination.

Provisions which by their nature should remain in effect after termination, including provisions relating to intellectual property, liability and applicable law, will remain in force.

22. Privacy

The processing of personal data is governed by our Privacy Policy.

When you use our webshop, personal data may be processed by Djamila Celina and by service providers who assist us in providing our webshop, including Shopify.

Because our webshop uses Shopify, personal data may be processed or stored in other countries where this is necessary to provide the services and in accordance with applicable privacy laws.

23. Consumer Protection and Mandatory Law

If you reside as a consumer in the European Union, all mandatory consumer rights of the country in which you reside remain applicable to the extent required by applicable law.

No provision in these General Terms and Conditions is intended to exclude or limit statutory consumer rights.

24. Alternative Dispute Resolution

We aim to resolve any complaints directly with you first.

We will endeavour to process your complaint as quickly as possible.

The former European Online Dispute Resolution platform (ODR/OS platform) was discontinued on 20 July 2025 and is therefore no longer listed as an active dispute resolution platform in these terms.

Where legally required or available, consumers may make use of a competent alternative dispute resolution body.

25. Applicable Law

These General Terms and Conditions and the contractual relationship between you and Djamila Celina are governed by the laws of the Federal Republic of Germany, to the extent permitted by law.

If you reside as a consumer in another EU country, this choice of law does not affect the protection you are entitled to under mandatory provisions of the law of your country of residence.

You therefore retain the protection afforded to you under applicable mandatory consumer law that cannot be contractually waived.

26. Changes to These General Terms and Conditions

We may amend these General Terms and Conditions from time to time when necessary, for example due to changes in our services, business operations or applicable laws.

The most recent version will always be published on this page.

Where an important change must legally be communicated to consumers, we will do so in the manner required by law.

The version of the terms applicable to your order is the version in force at the time the contract was concluded, unless otherwise required by law.

27. Severability

If any provision of these General Terms and Conditions is declared invalid, void or unenforceable, the remaining provisions will remain fully effective.

The relevant provision will, to the extent legally possible, be replaced or interpreted in a manner that comes as close as possible to the original economic purpose without violating applicable law.

28. Entire Agreement

These General Terms and Conditions, together with the Privacy Policy, Return and Refund Policy and other terms expressly referred to herein, constitute the agreement between you and Djamila Celina regarding the use of our webshop and the purchase of our products, to the extent permitted by law.

If any provision of these General Terms and Conditions conflicts with mandatory consumer law, the mandatory statutory provision will prevail.
